Some legal battles can look like real ones. Some lawsuits stand out because they have immense capacity to gather public attention. One such case involving the corporate industry is the Innovation Ventures, L.L.C. v. Custom Nutrition Laboratories.
So why is this case so intriguing? It revolves around 5-Hour Energy, an American-made “energy shot”. It is manufactured by Living Essentials LLC. These are two-ounce shots that promise to be more effective in giving energy than coffee.
So, How Did The Lawsuit Originate?
Sixteen years ago, Innovation Ventures and Custom Nutrition Laboratories together started making these shots called 5-Hour Energy. Now, the big legal issue revolves around what special ingredients are present in these shots that make them so famous.
The legal battle could have some serious consequences. It could affect what information we consumers receive about the food and supplements we buy. The lawsuit could also determine our consumer rights as a citizen of the United States.
Cross-Motions For Summary Judgment
The case consists of many rounds of “cross-motions for summary judgment.” Both parties to the case have requested the court to decide in their favor without going to a complete trial.
However, the cases are still heading toward a trial. This means that the court has not sanctioned any of the requests.
The USA Herald reports that if the court agrees with Custom Nutrition Laboratories, the shot’s ingredients could change. It could have consequences for people who have been daily consumers of it.
If Innovation Ventures wins the battle, it could give way to a secret formula and make companies tell us more about what’s in our supplements.
